Terms and Conditions

Read our terms and conditions for using UVC Legal's services and website. Please ensure you fully understand these terms before engaging with our services.

These terms and conditions, together with any schedules represent the entire agreement between the parties. No variation to these terms and conditions shall be effective unless in writing and signed by the client.

1. Definitions:

1.1 "We " or " UK Visa Centre Limited / UVC Legal " shall mean ", UK Visa Centre Limited" and affiliate, subsidiary, parent, holding or associated company thereof and identified as such in any communication or invoice to the Client as the context requires.

1.2 "The Client" shall mean the person, company or entity engaging " UVC Legal" " to provide consultancy services or make application to obtain a Visa or work permit or entry clearance under these Terms & Conditions on their own behalf or on behalf on in identified third party.

1.3 "The Agreement" shall mean the contracted engagement by the Client for the services provided by " UVC Legal" " for the provision of consultancy services leading to a visa application and subject to these Terms and Conditions.

1.4 "Visa" or "work permit" shall mean any form of entry to a particular Country. This includes work permits, work visas, permanent immigration, highly skilled migration and any other type of visa.

1.5 "The Fees" shall mean " UVC Legal" professional fees to represent the Client in a visa application. The details of the standard fees available on request. However the Director of " UVC Legal" may amend the same in writing, if required.

1.6 "Third Party" shall mean any individual person or corporate entry made party to the engagement of " UVC Legal" by the client as detailed above and including but not limited to an Employer, Recruitment Agency or individual job seeker or prospective employee, any third party being similarly subject to these terms of contract upon being made party to the engagement of UVC Legal by the client.

1.7 "Application" shall mean the preparation and submission of any documents, material or verbal statements howsoever transmitted to the intended recipient and made in respect of any immigration benefit or employment authorization, including but not being limited to work permits, visas applications for leave to enter / remain, petition approvals, landing rights, changes or adjustments of status, naturalization and citizenship, which benefit or authorization may be conferred by the Government of the United Kingdom and any other World Government as may be applicable from time to time. Applications may or may not be a component part of any consultancy service.

2. Services by UVC Legal

2.1 Where the UK Visa Centre has been contacted through an affiliate office overseas, such an office will never portray itself as competent to provide any form of immigration advice, service or referral save for the purpose of data collection for onward transmission to the last end. All advice, service and or referrals are conducted in UK by competent staff and affiliate offices overseas duties are limited as above, including where permitted and with client’s full prior written notice, provide a competent support staff to accompany the client to the nearest British Embassy, for the purpose of Visa Application Support only

2.2 UVC Legal undertakes to use its best endeavors to obtain a Visa or approval for the Client. Immediately upon the Client's engagement of UVC Legal to commence consultancy services or make any application, the Client agrees to the terms of this agreement and further the Client agrees and accepts that UVC Legal is under no obligation to commence or undertake any work in respect of that service or application until such requested initial UVC Legal and/or data has been received and passed as satisfactory by UVC Legal. In the interests of clarity, acceptance of these Terms and Conditions is required only once from the Client and any subsequent communication by the Client to UVC Legal pertaining to any application will be similarly binding upon the Client.

2.3 Subject to Clause 3, 4 and 5 hereof if UVC Legal is unable to obtain a Visa for the Client, then UVC Legal shall refer the client to a higher competent practitioner without refunding any deposit paid to The UVC Legal. Fees paid to UK Visa Centre are considered as Pocket expenses.

2.4 UVC Legal is registered under Level 1 with the IAA and if the client's case needs services by an Immigration Advisor competent and registered at level above 1, UVC Legal will refer the client to such other advisor. The services provided will cover the initial and complex visa application or extension of existing visas including work permits and asylum applications. UVC Legal will not handle Asylum Substantive interviews, or other Asylum / immigration appeal cases in respect of refusals of applications except on emergency cases or where further or immediate referrals are not possible. All appeal cases attract further fee payments.

2.5 UVC Legal’s office address and that of it’s affiliates cannot be used by clients for any other reason (eg Proof of address) except for legal representation.

3. Co-operating with UVC Legal

3.1 The Client undertakes - on instructing UVC Legal to apply for legal representation with UK Immigration matters or thereafter promptly on receipt of any request from UVC Legal - to provide accurate and detailed UVC Legal and documents regarding the personal details, qualifications and work experience, the earnings, the achievements and job offer (including, if applicable, a copy of any contract between the Client and any third party pertaining to such work) and any other UVC Legal or documentation that in its sole discretion UVC Legal may deem necessary in order to obtain a Visa for the Client.

3.2 The Client warrants that any UVC Legal or documentation provided to UVC Legal pursuant to sub-clause 3.1 above shall be true and accurate and further the Client hereby indemnifies UVC Legal for any loss or damage UVC Legal may suffer directly or indirectly as a result of the Client's breach of this sub-clause such loss or damage including but not being limited to the legal costs of defending any civil claim or criminal penalty against UVC Legal arising from the Client's breach hereof.

3.3 The Client warrants that, once UVC Legal is instructed in any case, that all representations to and contact with the relevant authorities will be made via UVC Legal and that at no time will the Client, or any agent of theirs, contact or make representations to any authorities with whom UVC Legal is dealing or with whom UVC Legal is about to deal, without the written consent of UVC Legal.

4. Payment

4.1 Unless otherwise, the Client agrees to pay to UVC Legal a deposit of fifty percent of the fees at the same time as instructing UVC Legal to obtain the Visa or to start consultancy services.

4.2 The Client agrees to pay the balance of the fees due within 7 days of receipt from UVC Legal of an invoice pertaining to same.

4.3 Should the Client instruct UVC Legal to withdraw the Visa application subsequent to instructing UVC Legal to apply for same but prior to submission to the relevant authorities of the application then sub-clause 2.2 hereof notwithstanding UVC Legal shall be entitled to retain any deposit paid by the Client in respect of the application.

4.4 Should the Client instruct UVC Legal to withdraw the Visa application subsequent to instructing UVC Legal to apply for same and in any case upon submission to the relevant authorities of the application then sub-clause 2.2 hereof notwithstanding UVC Legal shall be entitled to retain and charge full fee quoted in respect of the application.

4.5 Should the Client fail to provide documents / UVC Legal by due dates as required by the relevant UK Immigration authorities or within one month of having instructed UVC Legal to apply for same but prior to submission to the relevant authorities of the application then sub-clause 2.2 hereof notwithstanding UVC Legal shall be entitled to retain any deposit paid by the Client in respect of the application.

4.6 In the event that sums due hereunder are not paid within one months of falling due UVC Legal shall have the right to charge interest on such sums at a rate of 3% (Three Per Cent) above the then prevailing minimum lending rate set from time to time by the H.S.B.C Bank plc per annum calculated on a day-by day basis for each day after one month after the due date that the sum remains unpaid.

4.7 All fees quoted by UVC Legal in fee schedules and generally in correspondence and in conversation, are exclusive of disbursements; such disbursements are payable by the Client in addition to UVC Legal 's fees.

5. Termination & Suspension

5.1 The Agreement shall be terminated automatically if we do not receive fees as quoted and agreed upon by both parties.

5.2 The Agreement shall be suspended automatically on the occurrence of an event of force majeure being an event, occurrence or circumstance beyond the control of either party which operates to prevent either or both of the parties hereto from fulfilling any of their obligations hereunder such suspension continuing for as long as the event of force majeure shall continue and applying to any and all such obligations affected thereby only.

5.3 In the event of either party hereto being in breach of these Terms and Conditions the other party may by seven days' notice in writing specifying each breach and demanding remedy thereof suspend the entirety of the Agreement for such time as the breach or breaches so specified remain un-remedied save that if such breach or breaches remain un-remedied for a period exceeding one month then the non-breaching party may terminate the Agreement forthwith by notice in writing.

5.4 The Agreement shall terminate automatically in the event that any suspension hereunder shall continue for a period of six months from the date of suspension.

5.5 Our policies on refund is to honor any application made against all unspent funds and made payable within 90 days from the date of the notice in a manner, method and sequence under which such funds were received, provided such is made within six months of the termination of this agreement.

5.6 We shall; not be held responsible to make refunds for any funds meant to third parties, where the client has successfully or unsuccessfully obtained a visa, a refund application made as a result of refusal to grant visa by British Immigration Authorities as a direct result of negligence, act of fraud, non-compliance with required policies and or production of misleading UVC Legal by the client during this representation.

5.7 Where fees were paid from overseas, such refunds to overseas recipient’s accounts may attract financial institutions deductions for which the UK Visa Centre has no control

5.8 UK Visa Centre has no control over the length of time such funds may reach the recipients accounts once refunds will have been debited from UK Visa Center accounts

6. Liability

6.1 Save as specified in sub-clause 2.3 hereof UVC Legal shall not be liable to the Client for any loss or damage whatsoever suffered by the Client as a result of a delay in UVC Legal obtaining a visa or failure to obtain any visa hereunder.

6.2 The liability to UVC Legal arising from the negligence of any UVC Legal employee or agent of UVC Legal shall be limited to any professional fees already received by UVC Legal.

7. Complaints

8 General

8.1 Any notice to be served here under may be sent by regular second class post to the principal place of business or the registered office of the party to be served and, if sent by mail, such service shall be deemed to have been effected on the fifth day after the date of posting.

8.2 The unenforceability of any part hereof shall not affect the enforceability of the balance hereof.

8.3 These Terms and Conditions shall be governed and interpreted in accordance with the Laws of England and Wales and the parties submit to the exclusive jurisdiction of the English courts.
